The California Environmental Protection Agency (CalEPA) is committed to protecting the privacy rights of individuals, as enumerated in Article 1 of the California Constitution, the Information Practices Act of 1977, and other state and federal laws.

It is CalEPA’s policy to limit the collection and safeguard the privacy of personal information submitted to, collected by, or maintained by CalEPA. CalEPA’s information management practices conform to the requirements of the Information Practices Act (Civil Code section 1798 et seq.), the Public Records Act (Government Code section 6250 et seq.), Government Code Sections 11015.5 and 11019.9, and other applicable laws pertaining to information privacy.

CalEPA adheres to the following principles in connection with the collection and management of any personal information obtained by CalEPA while you are using this website:

CalEPA collects personal information on individuals only as allowed by law.

Personal information, as defined in the Information Practices Act, includes information that identifies or describes an individual including, name, Social Security number, physical description, home address, home telephone number, education, financial matters, and medical or employment history.

CalEPA limits the collection of personal information to what is relevant and necessary to accomplish a lawful purpose of CalEPA.

For example, CalEPA may need to know an individual’s home address, email address, or telephone number in order to answer the individual’s questions or provide requested assistance.

CalEPA collects personal information from persons who browse this website.

The information that CalEPA automatically collects includes the domain name or Internet Protocol address that relates to the machine used to access this website, the type of browser and operating system used, the date and time when this website is visited, webpages displayed, and any forms that are downloaded. Session cookies are deleted as soon as you close your web browser. CalEPA does not use cookies to collect or store personal information.

CalEPA collects personal information about individuals through this website only if an individual provides such information to CalEPA voluntarily through sending email.

We may use your personal information to contact you with information that may be of concern to you. You may opt-out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting CalEPA’s privacy officer at the contact information provided below.

CalEPA notifies individuals at the time of collection the purpose for which the personal information is collected and the general uses that CalEPA will make of that information.

With each request for personal information, CalEPA provides the authority under which the request is made, the purpose for the collection, the principal uses CalEPA intends to make of the information, and the possible disclosures CalEPA is obligated to make to other government agencies and to the public.

CalEPA uses personal information consistent with the purpose for collecting it specified at the time of collection.

CalEPA will not use personal information for any other purpose unless it obtains the consent of the subject of the information to do so or unless authorized by law or regulation. CalEPA must comply with the Public Records Act. The Act is a law that protects the public’s right to access records of government agencies. It also recognizes each individual’s right to privacy and therefore provides an exemption to protect personal information contained in agency records. CalEPA will release information only as required by the Public Records Act.

Individuals have the right to review personal information provided to CalEPA.

CalEPA uses information security safeguards.

Reasonable precautions are taken by CalEPA to protect the personal information collected or maintained by CalEPA against loss and unauthorized access, use, modification, or disclosure. CalEPA uses strong encryption software to protect the security of individuals’ personal information during transmission of such information through this website. Such personal information is stored by CalEPA in secure locations. CalEPA’s staff is trained on procedures for the management of personal information, including limitations on the release of information. Access to personal information is limited to those members of CalEPA’s staff whose work requires such access. Personal information is destroyed according to CalEPA’s records retention schedule. CalEPA conducts periodic reviews to ensure that proper information management policies and procedures are understood and followed.

In general, CalEPA encourages all individuals to use appropriate safeguards to secure their computers and the information on those computers.
